Well the deal is that it is hard to say. The FDA is complicated. I have delt with them. Most of the time complaints go no where at first. For years. Trust me..They have looked at Alex. But the thing is that they go after people causing real substantial damage first. Like for example a guy I know Dr Overman just got a lot of his business shut down. But this happened because he claims to cure cancer with his pills. So Alex has not crosses that line. But on the other side of the coin the FDA is weird. They can just act all of a sudden. Usually because some person high up in the organization gets ticked off and has power. So Alex could go for many more years or have a problem tomorrow.
And what happens is that the FDA sends the person a letter telling them to stop making the claims they are. The letter always says that they have 15 days to change. Then the person changes or gets lawyers. But it is not worth fighting so they stop saying what the FDA does not want them to.
Now here is the deal. Even if the FDA notified Alex. Alex would have to stop advertising the way he is. But you are independent from Alex. So you could advertise any way you want and the FDA would have to now send you a letter. Alex would not be in trouble as long as he claimed that he did not know how you advertised.
So the worst thing that can happen really if that Alex gets the 15 day compliance letter. He can stilkl sell the products but not in the manner as before.
But in Answer to your question it could happen tomorrow or in another 10 years. Who knows. It all depends who at the FDA gets angry. But if a person complains on the FDA web site little will happen. Some dumb bimbo filters those complaints and if they are not claiming to treat specific bad diseases they usually do not listen. But it a few people write certified letters to a high up FDA person it could be a disaster.

And Alex is not doing anything illegal. It is not illegal until the FDA interprets the law. And after that you can fight it and let the court rule. But that is expensive.

i think the government should hire someone to come to your house and make fun of you for spending so much time at a message board making fun of a technology you don't think works. that is, by far, the nerdiest thing i can imagine a person spending their time doing
